Last week, Paul filed an amicus brief in the Funk v. Scripps defamation lawsuit on behalf of thirteen national media entities and a national public interest group in the Tennessee Supreme Court. The brief challenges a limitation on the fair report privilege that permits defamation plaintiffs to overcome the privilege with a showing of express, or ill-will, malice as unconstitutional, against public policy, and illogical. He also advocated for a limited interpretation of an exception to Tennessee’s statutory
journalist’s privilege, Section 24-1-208(b) of the Tennessee Code Annotated.
